Need help on what to do first. Attended Bellarmine University in Louisville KY in the early 90's. No loans were taken out, my father paid the bills. Just received a collection letter from Williams & Fudge. They have reported to all 3 bureaus. They have reaged the "debt" on my report to 5/03. I called the University as this has all happened before (2003)...all negative TLs were removed from my report. I thought this was a done deal. She (the bursar) told me there was no SOL on education...I know better this is not a loan. Asked if I was refusing to pay...I told her I did not owe the money. That it was reaged and illegally on my credit report. She just asked me for proof of payment from 2003. The final payment made by my father was on 2/10/93...16 years ago! Do I start with a validation letter to the CA, or go with the viloations they have...not sure where to start with this one. It is killing my credit and need to get it removed!! Dispute with the CRA's...I do not want to screw this up...any help would be much appreciated. Thanks!
Get them to start putting things in writing. Ask for their mailing address. Don't tell them why, just ask for it. If they refuse to give it, Google their name and find it yourself. Send a letter, via certified mail and with a return receipt requested, telling them that it is inconvenient for you to receive telephone calls and that you prefer to communicate in writing. Tell them you are disputing the debt and want validation of the debt. Then leave it at that. They will probably disappear. It sounds like you may have several violations of the FDCPA / FCRA in your favor here. Maybe one of the members with more experience in that area can help, but this is why you need to put everything down in writing. If you slap them around with a few thousand in damages plus court costs, it may help them to "remember" next time they come after someone else ... or you ... that they must follow the law.
Just got an invoice from Williams & Fudge for Validation...it very clearly states dates from back in 1993! Is this all I need to forward to the credit bureaus for removel? It is WAY past SOL and time for it to be on a report. Clearly this has been reaged and is in violation of FCRA. Thanks for your guidance!
