I have a promotional block on my Equifax that was effective in January. This shows on my reports. I have 9 PRMs since then. Isn't this illegal.? What recourse do I have? Do they owe me $1,000 for each occurrence? What good is a promotional block if EQ lets everyone continue pulling my report? Please help..Thanks!!
It usually takes 60 days for the system to opt you out. If the inquiries took place after March I would definitely contact Equifax. Does your report state that you opted out? Dani
I have had the permanent promotional block since 1998 and I still get promotional inquiries on my Equifax, Experian, and Trans Union reports. Interestingly enough, my Equifax report includes a statement specifying that my file is blocked from promotional inquiries while my Experian and Trans Union reports make no mention of my blocked status. This does qualify as a FCRA violation ($1000 max per violation). However, only actual damages up to $1000 can be awarded. I don't know how you would go about proving actual damages arising from a promotional inquiry since creditors don't see PRM inquiries.
