PROBLEM - Help

    I am working on someone's reports. She ha a judgment for an apartment in the amount of $774...But there is also a collection from the same people in the amount of $1367. I called and they verified via name. What do I do? How is this handled?

    Same was as any debt... Make the collection agency prove it.... If they don't within 30 days make them remove it.

    You will probably want to go down the the Clerk of the County Court's office and pull the judgment file and check to see if it has the proper affidavits and that they are all in proper shape.

    You may be able to get the judgment reversed and voided. If you had grounds you would probably want to file motion to vacate with the court.

    I have all the forms available and I'll be glad to help you do the research to see if you do in fact have grounds to file on the judgment.

    I do it for quite a few people and there has only been 1 so far in which the legal work wos done so properly that there was no room for attack that I could find.

    So your chances are pretty good.

    The cost would not be great. Probably about 6 to 10 dollars. That's about what it seems to cost for the court certified copies of the average judgment so it's not much to see if you have a way to go or not.

    Let me know when you get them in. I will want you to make copies of your originals and mail them to me so I can look them over. I will see if I can come up with some ideas and thoughts for your consideration and get back to you.

    You realize, of course, that there will be no charge whatever for this and that I cannot give you any legal advice. I just enjoy doing it.
