I had a $2088 collection on my CR for an apartment that I was living in 2 years ago. In March, I made arrangements with the collection agency on this account. It was agreed that they would settle for 75% payment as long as it was received in their office by 3/31. They sent this agreement to me in writing, but without a signature. Needless to say I sent the $1,566 to the collection agency as settlement. Meanwhile, they have reported to the CRAs that I still have a balance owing of $522.

First, was the agreement binding without a signature? I upheld my part of the agreement. I've called them to get letters stating that this account has been settled and PIF. They faxed a letter, in the body it says PIF, on the header line it has balance $522. I've contacted the CRAs and disputed the amount due, but it will take another 30 days before I receive any notification.

Second, can I sue the collection agency for breach of contract?

    Thanks for your help.
