I'm searching for some advice, maybe tactics.. lol. My fiance received one of the now-numerous collection letters from CAMCO. As is their practice, this is a debt that is, I'm quite sure, beyond the SOL. The debt was incurrred in either IL or NY, both of which have an SOL on credit cards of 6 years. My fiance has copies of his CR from 2 of the CRA's that he pulled A YEAR AGO and this debt referred to by CAMCO doesn't show up anywhere ! To me that means the account is already past the SOL if a year ago it wasn't on his credit reports. This is an old CitiBank card and CAMCO bought it from another CA called Fourscore something. Our dilemma... my fiance has moved numerous times in the past 10 years and he no longer has any records of this old account. I'm hesitating to send a validation letter which would demand they provide necessary dates, because CAMCO seems to be filing suits very quickly. Even though that suit would be illegal, WE have to prove the SOL is up, and I don't know, without his old records, how we do that. Question ... does anyone have ANY idea how we get records to PROVE this debt is beyond the SOL ?? I'd feel much better about sending the validation demand if we knew, without a doubt, that the SOL has expired. Is the fact that it has already fallen off his CR enough proof ????? This scum CA is trying to get over $8K, and I'm 99% sure this is crap !! Any suggestions greately appreciated
I don't know. He's been out of town and only just gotten back. Since *I* can't pull them for him, he's going to have to do it. They'd better not be, that would probably be an illegal re-age.. and if CAMCO does that we've got 'em in a violation !
due a search for david Szwak on this board... He is filing class action suits against this kind of stuff and needs people like you.. s
Ladynred, That's what I was driving at. If the report today doesn't show Camco I'd say "fire for affect". If it does show Camco then, your fiance should sue over reaging.
