Problem with Mortgage Company

    All,

    I'm in a Chap 13 plan. I've recently sought and received permission from the court to refinance my mortgage.

    Since I have a FHA loan the mortgage co I found see no problem in granting me the loan. Yesterday the guy goes to check my mortgage payment history and discovered that the mortgage Co isn't reporting anything. On Sept 2002 my original loan was purchased by a new mortgage co. Midland Mortgage Co.

    I filed the proper papers with the attorney and he filed with the trustee. The trustee has contacted the mortgage co twice requesting a they file their claim so payment can go to Midland instead of my original mortgage holder.

    As of 4/22/03 they have not filed the claim. This was OK because Homeside was forwarding the payments. Starting this months Homeside has started sending the payment back to the trustee.

    A review of my payment history with midland online shows my last payment was in Feb 2003. This makes it look like I'm not making my payments on time which I am - In fact I have no choice the payments are deducted from my paycheck.

    What should I do?

    As long as you have proof the payments were made on time, this should be no problem to get what you want.

    This transfering of mortgages and selling them to different lenders happens all the time.

    As long as you have a good attorney and trustee they should be able to handle this.
