Procedural Request Results?

    Has anyone used a procedural request to get two successive investigations in a row?

    I'm asking this because I'm wondering if a procedural request really carries more weight than a normal dispute letter? I know in theory it does, but in practice I question its true effectiveness.

    I sent out 3 procedural requests for CHOD and only one succeeded in getting a new investigation, the other two were pretty much ignored.

    The one that did work was to EQ, but they had already ignored two previous dispute requests before accepting the new dispute with the "procedural request". EQ never even answered my procedural request, they just started a new investigation. I think a normal dispute letter would have probably accomplished the same thing?

    Anyone have different results?

    They only have 15 days to answer your procedural request. Starting a new investigation is not an acceptable answer.

    Good point. They never did answer it either. I finally have them on a violation come to think of it. Thanks.

    Sent a procedural request to Experian and never heard back. After a month I sent an intent to sue. About a week after they received the Intent letter I got back a letter saying that the two items had already been investigated. This after specifically saying in my procedural request and my Intent to Sue that I was NOT asking for the items to be re-verified.

    I'm heading to the courthouse next week to file suit.

    The last letter I wrote about Procedures, before I listed each point I put in bold all caps "This is not a request for a reinvestigation". When they screw it up, they will have no way of saying I was unclear and they THOUGHT I was requesting a new investigation!

    I have the same thing with equifax, they just started a new investigation! Do you think a long 3 page *nutcase style* with reference to possible legal action would possible get their attention?

    On the same note, I have gotten the results back from my initial dispute, but I got them back last week. I need to send out a procedural request letter now, I should have done it last week.

    Can you ask for a procedural request anytime after you get your results back? I know the sooner the better, but is there an actual cutoff date?

    I sent a procedural request to Exp and also have npt heard anything. I am plotting a new strategy now. Should I send a fax restating the request and highlight the FCRA guideline that applies to procedural reuqests?

    I did something a little different than you guys. I sent the procedure request with the dispute letter. I hope they give me a violation by not answering it. My resultes are due around the 13th of feb.

    Anyone on this thread have any results from your pending procedure requests?? I haven't heard back from EQ (received 3-17) so I am formulating my next plan.

    Any input?

    I sent 2 requests to EXP and they keep sending me back a letter telling me they need more info to reinvestigate.

    I'm planning on suing too. The good thing is they admit receiving my letter. I sent it regular mail.
