I keep all my old reports, and for the last few months I was on a hiatus with my credit reports. I have since resumed and always thought I had got Providian removed from Equifax. Well I just checked and it was removed. It now reappears as the same 2 accounts with different account numbers. Any suggestions? Thanks!!!
CSC deleted a rei-inserted account the next day for me when I faxed the following letter, but my account number hadn't changed. Here it is if you want to try it. Is your Equifax through their CSC affiliate? If not, you will need different contact information. I included a copy of the letter where CSC informed me of the deletion. YOUR NAME ADDRESS CITY, STATE ZIP DATE Ms. Cricket Dalton CSC Cincinnati PO Box 674406 Houston, TX 77267 Fax (281) 878-4882 Dear Ms. Dalton: I am writing to you concerning an account that was deleted from my CSC credit report on June 10, 2002 and has since been reinserted without your company notifying me. The account is: Genesis Financial Solution a/c xxxxx As I am sure you are aware, per the FCRA section 611: (B) Requirements relating to reinsertion of previously deleted material. (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. (iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion (I) a statement that the disputed information has been reinserted; (II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; and (III) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the disputed information. (C) Procedures to prevent reappearance. A consumer reporting agency shall maintain reasonable procedures designed to prevent the reappearance in a consumer's file, and in consumer reports on the consumer, of information that is deleted pursuant to this paragraph (other than information that is reinserted in accordance with subparagraph (B)(i)). As it is well past five days since this account has been reinserted and I have received no notification from your company, I am asking that you delete this item in order to avoid legal action. I have included a copy of the letter from CSC dated June 10, 2002, verifying the deletion of this account. Sincerely, YOUR NAME Cc: MY FRIEND THE LAWYER
Is everything else on the account the same? Dates, amounts, etc.? If so, I think I would try the letter and point out that they changed the account number as a deceptive act. Although, I am not an expert. Do you have any idea WHERE this new account number came from? Tell Eq that if it is REALLY a different account, you dispute it as having no knowledge of it, which is true.
Yes both opening dates and balances are the same. I will send it and see what happens! Thanks for the help.
Good luck! Let me know what happens. By the way, if you don't go through CSC for your Equifax report, you will probably want to e-mail the letter to Lanette.Fullwood@equifax.com. I think it goes without saying, but I am not the original author of this letter or information, just a method I applied after reading this and other boards. Thanks EVERYONE for the great information.
