My mother just called to tell me that a rep from Providian just called her at home to try to reach me. We live in separate houses, I don't even know how they got her number - we have different last names. He said this was a personal banking matter. I'm a couple weeks late but not 30 days. Is this a violation or just rude? Can I do anything about it? thanks - poochie!
Well, Providian would be an OC, not governed by the FDCPA, but even if it were a 3rd party debt collector, they are allowed to locate you, and from your post they didn't discuss the debt with her. I bet when you filled out the app you put your Mom as the "closest relative not living with you". I would tell your Mom to send them a cease and desist letter and see if that does the trick.
