Providian Chargeoff-get off report

    Quick question-

    I have a paid Providian chargeoff on my TU and Experian report from 2000, does anyone how I can have the negative entry removed from my file, through Providian the CRA's won't investigate it anymore so I am wondering has anyone ever dealt with this situation, Is this an easy task ?

    What letter should I use or what should my own letter consist of .

    This will not be easy because they have no incentive to do anything for you anymore because you paid it already. Try disputing it again after a year or so -maybe they will have forgotten you although Experian posts investigation results on the online CR. The good news is that old charge offs have less of an impact on your score as they age.

    Write them and tell them them you are in dispute over the account.

    Send it CRRR.

    Wait a copule of months and pull another credit report.

    See if "Consumer disputes" is listed.


    If it is not then file your suit, you now have the leverage you need to speak to one of their attorneys to get it reported the way you want because of this simple violation of the law.

    This will work for any debt or any information which is currently on your report or from anyone who is furnishing such info about you.

    They must regardless of the fact communicate to the bureaus that you are in dispute. It doesn't matter what the reason may be.

    I can guarantee you they won't list it in dispute.

    Now go get'em!

    Wow Did not think of that? Will that suit actually cause a deletion of the account or monitary reward or both if it is successful? So the trick is to fight the original creditor on this one.

    Yes, it can and will work.

    The deletion will happen because this is what you will offer to them to settle out of court.

    You will have to send several letters to them.

    If they respond it will only be from their research department or such.

    Only when you actually file the suit and they are served will the really important person contact you and offer to settle.

    This is where you offer to settle for court costs and full deletion, or any other thing for that matter.

    If you only ask for the deletion and court costs they really have nothing to gain by not doing what you ask.

    I'm afraid to tell you that my experience with Providian has been that you will actually need to file the suit for a real response from them to happen.

    This will be from their attorney who has the power to make things happen.

    An attorney's main function is to reduce liability to the company they represent.

    If simple deletion is what you ask they will comply.

    Make sure you have them on the dispute thing though.

    Keep very accurate records over the next 5 months as well as current copies of your credit reports monthly showing that they failed to follow the law.

    It will work.

    I had a paid Filenes late (it was 30+ times 90days late, but it never made it to charge off) on a whim one day I wrote them a goodwill sob story on PFB, and within a week, they deleted all the negs, and kept the account on my report, so it's now reporting paid/never late.

    was the account closed when you sent the goodwill letter in?

    Yes, It was a catch 22 situation. I wanted it cleaned up, but it was still open. I could close it and lose a 13 yr old tradeline, or I could leave it open w/ all those lates. It was going to be reporting for 18 more months, so I closed it before I sent in the goodwill letter (I didn't want them to pull an inq. on my cr) I actually couldn't believe that they kept the TL on my reports. I thought they would delete the entire thing, if they did anything at all. I never dreamed they would just make it positive for me. Worked out great!!
