I am filing a lawsuit against Providian. The address on the back of the credit card is right up the road. I am intending to file locally. I need your help. My husband got this card a couple years ago and could not keep up the payment, when they started to add all THEIR CRAZY FEES. Needlees to say this card had a 500.00 limit and is reported on his credit report as owing over 1200.00 crazy. There must be some laws on this? Help what should we say in the law suit?
Lawsuit section of the FAQ... Browse it all, but in particular, see Lizardking's lawsuit template. -Peace, Dave
Has this account gone to collections? i.e. Is a CA attempting to collect on you for this debt? If so, have you attempted any type of validation? I only ask because from the information you've provided, a lawsuit may be premature at this point.
I too had a Providian with a $1500.00 limit, with all of their fees, penalties etc.... has added up to over $2600.00. Unless you know for a fact the information is incorrect or they haven't listed this account as in dispute when you've given them notice your gonna be out of luck regarding your lawsuit. They will simply point out to the judge the truth in lending paper supplied with your credit card listing all of their stupid fees, etc.... Get them on a FCRA violation for failing to dispute. When they fail to do this you can then nail them on this and get the leverage you need! Be prepared as I have heard of stories where Providian will counter sue you for the money you owe them or they claim you owe. Good Luck! Tac
