pulling teeth with MBNA

    This all started on 8/28/2003. I have disputed with TU twice, no luck.

    Dear Sirs:

    I have become aware that the credit agency Trans Union is reporting that your agency has 2 hard inquiries into my credit account dated 8/28/2003. This is the same day that I applied for the above referenced account. However I did not apply for this account twice as is indicated on my credit report.

    I feel this is an error on my credit report and desire that the error is fixed on all credit agencies that you report to. If your records indicate different please provide documentation indicating otherwise.

    According to the Fair Credit Reporting Act, it is my desire that your agency correct this erroneous information as soon as possible. (referenced below)

    §623. Responsibilities of furnishers of information to consumer reporting agencies [15 U.S.C. § 1681s-2]

    (2) Duty to correct and update information. A person who:

    (A) regularly and in the ordinary course of business furnishes information to one or more consumer reporting agencies about the person's transactions or experiences with any consumer; and

    (B) has furnished to a consumer reporting agency information that the person determines is not complete or accurate, shall promptly notify the consumer reporting agency of that determination and provide to the agency any corrections to that information, or any additional information, that is necessary to make the information provided by the person to the agency complete and accurate, and shall not thereafter furnish to the agency any of the information that remains not complete or accurate.

    Dear Ms. Fisher

    This is a reply to your November 26, 2003 correspondence.

    In my original October 17, 2003 letter I mentioned, â??I have become aware that the credit agency Trans Union is reporting that your agency has 2 hard inquiries into my credit account dated 8/28/2003â?

    Your response mentions, â??We have submitted the necessary information to have the duplicate account reporting to your credit bureau removed. I also received a letter from Elaine Ayers (Credit Bureau Management department) dated December 1, 2003 stating â??we have asked the consumer reporting agenciesâ?¦to report the above MBNA accountâ?¦only one time.â?

    From these correspondence it appears that you are referring about the actual account reporting, which is only reporting once. The hard inquiries dated 8/28/2003 are reporting duplicate.

    I only applied for the above referenced account once on 8/28/2003. If you feel otherwise, please provide the permissible purpose of the second inquiry.

    As of the date of this letter, Trans Union is reporting two hard inquiries from MBNA on 8/28/2003. I feel this is an error on my credit report and desire that it is fixed on all credit agencies that you report to.

    I look forward to your written response and a resolution to this error.

    In another 21 days, these hards will be 6 months old and will no longer have any effect on your score.
