Q on how to proceed with dispute

    Hi guys,
    Hoping for a little help on how to proceed with a negative on my credit report.

    I recently found out that there was a 120+ day past due on my credit report from a property management company that I agreed to pay $70 a month to settle a bill. I have been paying faithfully for almost a couple of years now and the debt is almost settled.

    I called the company about the late payment on my credit report and it seems I missed a payment back in June which I didn't realize that I missed. I payed everything past June (i.e. July, Aug etc) as the bills came and the company never sent me a past due notice for the June payment but they reported that I was past due to the CRA not for $70 but for the full amount of about $500 remaining.

    The company's rep says that unless I can prove that I made the June payment with a copy of a canceled check there is nothing they can do about it. Is this true?

    Should I file a dispute with the CRA b/c the information is not accurate? or should I try to somehow fix this with the management company even though it seems like they will not budge. Any suggestions on how and what to say would be greatly appreciated.

    If the account is with a collection agency, then the debt has been accelerated and the total amount is due now (or the day you originally received the dunning letter). The payment plan you have with them is a courtesy that they can withdraw at any time. So, if you miss payments, I would fully expect them to ding you for past due on the full balance, not just the payment you missed.

    I don't believe that you'll get anywhere with the CRA on this, because the CA doesn't care. The credit bureaus give their data furnishers INCENTIVES to report NEGATIVE INFO, not positive info. So there's absolutely no reason or incentive for the CA to remove that late payment unless you can prove that it is patently INACCURATE (with a cancelled check, etc) and thus worth fixing from their point of view.

    If I were you, I would keep working on the CA. Ask nicely, send flowers, flirt, whatever. I think that's you're best bet, unless you want to go a totally different route and remove the entire tradeline all together.

    Thanks for the info cnoob.

    I don't think the CA will budge and I don't mind removing the entire tradeline. How would I go about doing that? The CA will verify all info.

    What kind of property are they managing ?
    Are you paying them or a CA.
    What is the money you're paying for?

    I'm paying a residential management company for some damage that was done by someone I co-signed a lease for. That person is long gone and I got stuck with the bill. I couldn't pay the full amount so I agreed to pay them monthly until the bill was settled. It hasn't gone to a collection agency, I don't think, but the CR said 'Collection Account' under comments. Does that mean I'm dealing with a CA and not the original management co?

    Either that or the CRA has the management co. listed as a CA rather than an OC.You do need to find out just what is going on.

    I think I'm going to try to dispute this with the CRA. This was for one missed payment in june. I paid everything so far up to this month and the June missed payemnt was reported to the CRA in Dec'03. WTH? Even the CA rep admitted it was for only one missed payment in june that was only 30 days late as I paid august's payment and seemed to be puzzled by the reporting of it but refuses to do anything about it.

    Any thoughts experts? What do I have to lose if I dispute this with the CRA?

    also,

    do you think it will make a difference if I paid off the whole debt then disputed it? i.e. help my dispute, or will it not make a difference?
