Question about an inquiry

    On my TU and EX reports there is a hard inquiry by Fleet CC last december. I called them today to ask why a hard inquiry was pulled since my account with them was closed in 1999. The CSR told me he could not find a record of the inquiry. Is this considered a violation?

    If your account was closed (and in good standing, i.e. you owed nothing to them) and you did not apply for credit with Fleet again, then there is no permissible purpose.

    The best you can do is have it removed...I don't think you could get $1,000...

    Call or write TRANS UNION and EXPERIAN...DEMAND REMOVAL

    GEORGE, why don't you think he could get $1000? If they had no permissable purpose.

    You would have to go to SMALL CLAIMS COURT and PROVE that they "INTENDED" to harm you and that you also had a SUBSTANTIATED LOSS worth $1,000...

    I have never gone to SMALL CLAIMS COURT...maybe I'm WRONG???

    There is a balance on the account, there have been some late payments in the past but it is currently up to date.

    If your account was closed, but was still carrying a balance, then the "business relationship" had not been completely terminated.

    Not sure what you could do other than asking them to remove the inquiry. It should have been a soft (like an AR), when they pulled your report last year, since they were not "extending" you credit (when they pulled). An AR inquiry gives the creditor the same info as a hard would when applying for credit.
