Are attorneys who are trying to collect a debt bound by the same laws as collection agencies? I have a local attorney who is trying to collect about $400 in medical debt that I honestly don't even remember incurring. Would I use the same validation and cease & desist letters as I would with any collection agency?
Yes, lawyers who collect on behalf of someone else are required to abide by the FDCPA. You may also want to check with the local bar association in your state to make sure the lawyer is admitted to the bar there. We had a company here that said they were attorneys and weren't even admitted to the bar.
