Ok, now I used to be a Collection Agent and I remember when someone would agree to pay off the debt but only if we agreed to delete the Tradeline, we would send them writing that we'd delete the tradeline or we'd tell them that it would be deleted. Did we ever delete...umm NO! lol So how do you MAKE SURE that they (or the original creditor for that matter) would delete the tradeline? I mean if you have it in writing how do you dispute that when they don't delete it? thanks for any help, I have some 'hidden' collections and I want to pay them but I want them deleted when I do pay them..... You send it (the letter) to the CRA. If they don't delete you can just sue the CA. They'll look pretty ridiculous in front of a judge when you submit their own letter saying they will delete the tradeline.
Atlmom, just a question. Why when someone pays, why do CAs insist that the info stays there. I would think that when someone gets their money, they would be happy to delete the negative info. What purpose does it serve the CA to have the info stay there? Do you have any experience with this? Or an answer?
Honestly, I have a TON of knowledge about CAs and can tell you that the general population has never even heard of the FDCPA, but we were required to have monly meetings about it. CAs get sued not too often and when they do they settle, for a LOT (usually multi-millions 1-3 or so). Attys who know about the FDCPA are few and far between. So small claims is the only way that most people go. But if you get into a TRUE lawsuit, you can make a TON! Also, CAs don't care about credit reports, they pay so little for the accounts (usually just pennies on the dollar) that they just want to make back what they paid for the account. I will say this, I routinely, went up to bat for debtors, and usually got a lot os TLs deleted, and accounts removed from our systems (or I hid them for people, who didn't care about their credit but weren't going to pay the bill, but were REALLY nice to me about) Hmmm wonder if that's why I never got those big bonus checks? and why I don't work for those crooks anymore? BTW, CAs don't care about your knowledge of the law they know that most of the threats are empty, or they don't know the law and think you're full of it. (Official looking letters are a MUST!!! Usually the people opening the mail are more professional than the phone people, ask me how I know ROFLMAO!!!) Hope this helps someone and if you want more info just ask! L.
