I am working on one of my last 3 stubborn Derogs. On this one I am dealing with the OC, so I need to plan carefully. I did have an account with this OC for many years and I THOUGHT it was paid and closed in 1996 but I am just not sure. It is now showing a large balance as a charge off. The DOL is 1997 so I am way past SOL in my state. I sent a dispute and they are asking for proof of residence from 1997. I dont' have it because I acutally moved around a lot during 1996-1999 but remained in the same state. So, what do I do? Can they say that since they couldn't find me the SOL stopped tolling? I didn't even know they were looking for me. My feeling is that I don't legally have to provide them with anything since it is up to them to prove I have a debt with them. I have asked for copies of signed sales receipts and checks used to pay the account to see if this may be an error or identity theft. So how do I answer this request without getting myself into trouble if it turns out they have the docs I requested and it is my debt? They also pulled a hard copy of my CR the day they got my dispute.
Tolling has NO bearing on this situation. Have you disputed this to the CRA as "obsolete". You should opt out on your credit reports, remove all your old addresses,and send a letter to the OC that you will file a complaint with the FTC and your State AG's office for their violation of the FCRA for misreporting and pulling an inquiry without any permitted purpose.

You don't have to have any documents on any debt that is beyond SOL. Why do you think there is a sol on debts?
