Question about statue of limitation

    I have old credit card debt that is well past my states SOL. I figured I was OK but now I understand my ex-wife and her new husband are filing bankruptcy and will make payments on it. Will this restart the SOL for me and allow them to file suit against me?

    Yes, she never paid anything on it after we split up. I always considered it mine and made payments on it for several years.

    To clarify the original question, when I said "allow them to file suit against me" I meant the debt collectors not my ex.

    You could end up with both an IIB notation on your reports, and a CA trying to collect from you, claiming the SOL was reset, since their actions against your ex are limited by the bankruptcy. You need to see an attorney.

    Thanks for the information. Something like this happening had never crossed my mind. Man, even after 10 years she's still finding ways to stick it to me !!

    Was the credit card mentioned in the divorce decree? If so you may have a case against your ex if they come after you.

    Another consideration:

    If anyone is considering divorce, or is divorced, it's important to sever any financial ties to credit cards.

    Some recommend cancelling the previous card with an authorized user, and requesting a new card that transfers the past credit history to a new account number.
