Ok, ya'll will like this one. My dh answered an "unavailable". Turns out to be a CA. This guy was an absolute nimrod! First, it was allegedly *my* debt, so he should not be talking to a third party about it. He told dh that he had run my bureau and that my credit is sooooo bad that he knows that I have no intent to pay my debt! (oh yeah, well where are the inq's?!) There is more, but I left those notes on my desk at work! I called the CA. I asked to speak to the guy's spvr. I am routed to a general voicemail box. I call and call until I talked to a human with some IQ above a rock. She routes me to a VM that at least announces the person's name. I lamblast the employee, tell them that he is in severe violation of the FDCPA and that I expected "one and ONLY one phone call allowed" to discuss this! No call back. Sent debt verification ltr. No response yet (only been 2 wks). But, I am still livid! Would I have to sue in their state?
A man named Shane Alslip from NCO Financial Systems was the guilty party. He told my hubby that the reason that I did not respond to their initial letter is that I probably cannot read or write! He then demanded payment from hubby and shared the details of the debt followed by telling him that he was looking at my credit report in it is so poor thant I dont intend on doing anything about it! (no, inq's on the CRAs, so it is a lie)! I called them and asked for his spvsr Bob Sanger. After getting the VM run around for a while, I was finally forwarded to Mr. Sanger's VM. I left a message. Haven't heard from them since!
NCO is notorious for that stuff. BUT, I think they are allowed to speak to your spouse about your debt, just not an employer or other third party. Someone correct me if I'm wrong. You still have them on harassment and I'm sure other violations though.
They are allowed to speak with your spouse, but I believe it is only limited to ONE occasion, or for the purpose of locating you. However, check you state laws, in NH they strictly prohibit the CA from talking to anyone other than the debtor.
SCmomof5, Sorry to hear you are going through a hard time with NCO, they are pretty low lifes for doing that. I think you have some good advice coming from both of these peoples.
