I will be going to court on 7/18/02 on a CA for several FDCPA violations and have a quick question for anyone who has been through this... The one violation im suing for is validation... I sent validation once i knew about the debt from pulling a credit report... Isnt there a staff opinion letter about the validation process is not only for when and if you receive a demand for payment from CA... The reason is the CA is gonna say to the judge we sent letter back in 6/99 and no response...
Guess what? How can he prove he sent a letter?? u have RR and stuff. They are too cheap to use certified mail. if u have t have proof, he does, too. make sure u document each violation, and have documentation to back it up. be professional, and serious. this is your credit, they cant just mess it up because they want to...
