Question for my daughter about dish

My kids have dishnetwork. They discovered they could get cable cheaper, so they cancelled the dish. My daughter checked her checking account balance this morning and discovered a $240 withdrawl from her checking account. I know they require a year contract, and I believe they charge a fee for early cancellation. She pays monthly with check by phone, but not automatic draft. Can they legally do this since it was not authorized? Thanks, Patti

Have you reviewed her contract to make doubly sure she didn't authorize it to connect the service?

hey jlynn!! I don't think she can find her head, much less a contract!! LOL!! I'm gonna head over there, and see what I can find. DH and I have had ours a year in March, and I'm sure they got theirs after we got ours, and I'm gonna check it out. But ours and theirs were bought outright, not financed through the company, and I don't know if that makes any difference or not.

Cable may be cheaper...for way less channels.
    Did you do the MATH???

I have DIRECTV and they made me pay one year in advance on my credit card but they refunded $300 in a check months later (THAT WAS THE OFFER AT THE TIME).

DIRECTV and DISH NETWORK and most CELLPHONES have a "EARLY CANCELLATION" PENALTY (it is SOP)!!!

You could call the bank MONDAY and dispute the charge...

When they cancelled...they should have been informed of any FEES relating to the cancellation.

Thanks, GEORGE!! I told them there was probably a cancellation fee, but we felt like she should have been notified before they did the draft.

The BANK can charge it back...

If the bank charges it back...DISH NETWORK may just send a
bill in the mail...A DEMAND FOR PAYMENT BILL!!!

When you do the math cable is not cheaper if you have to pay a cancellation fee. It's better to pay Dish's minimum plan payment for 6 months than the cancellation fee.

Most likely she cannot dispute it. When you sign up for Dish they ask for a credit card. You authorize them to use it if you cancel early to withdraw the fee. It was all in the original contract she signed when she first hooked up.

Around here you cannot get cable for under $35 a month so DISH is considerably cheaper. Where does she live to get such good deals?

    $24.99/month 1 TV 50 channel plan.

"A $240 cancellation fee applies to early termination of service contract."

Was the charge from dish or from the place that she bought it from?

    Was the charge from dish?

The company she bought the dish from might have charged her because the resellers make their money on those 1 yr contracts.

If she only has a couple months left you are better off just keeping it activated until the yr runs out.

You might have luck posting a msg on dbsforums.com.

At any rate, I would dispute the charge.

    Good luck

I had a similar problem with an internet provider called "Prodigy" they did exactly the same thing with my checking account.

I disputed the charge with the bank and filled out a form. Within 48hrs. the bank refunded and re-depositied my money. The bank told me they would investigate my claim and if they found it to be untrue then they would withdrawl the money back out of my account.

About 4 months later I received a letter from my bank stating the investigation was complete and my claim approved.

I never did hear anything ever again from Prodigy.

dishnetwork pulled the charge, they told her it was for her equipment and cancellation, but she bought her equipment outright from a local dealer. I told her to go by the bank at lunch, and see what she could do.

This kinda goes back to the old, read a contract before you sign it dealio.

If she bought the equipment, then she got screwed probably by the reseller into dish buying her equipment and her paying the reseller a fat profit line.

i still pay dish $5 a month for some reason too lazy to cancel it. "seasonal downgrade" is what i'm in.

Yep... I was told upfront about the cancellation charge, they made doubly sure on the phone that I understood I would be charged $240 if I cancel before the year contract is up. I don't think she can do a thing about it-- but I do agree they should have told her (or rather reminded her) about the cancellation fee when she called to cancel service.
