Is the UCC the only thing that regulates collection activities on business debtors? I have a good friend who owns his own business (S Corp) and he got wrapped up in a debt for services that were inflated 50% beyond the contract price but he hasn't done anything to protect his rights. Now he is getting really horrible calls from an outfit called Alexander & Hamilton, Inc (alhamco.com) - all the bad stuff, i.e. abusive language to his secretary, threats to sue, etc. My big question here is if he has the right to send a limited C&D so he can get any further communications in writing only. I would have some idea of what to tell him if it was a consumer debt but I don't yet know much about business debts. He is going to pay it but only after the service provider corrects the disputed amount. Thanks! Xavernus
He might check under his state's business and commerce codes, and DTPA (Deceptive Trade Practices Act) and see if there is anything there that might help him.
