The FCRA says judgments and public records can stay on your report for 7 years, except for ch. 7 bk which is for 10. Now, if you had a judgment against you but it has expired ( in Az. judgments are for 5 years unless renewed) that would mean the judgment no longer exists. How do you think someone should go about trying to have it deleted from their reports?
I would say dispute as nonexistent or irrelevant. Out of date, etc. If it is purged from the system, then what is there to verify and report? Right?
I agree that it is nonexistent, however, it isn't purged from the system. It shows the case, the decison, the amount and status of expired. I'm sure if the cra's verified it, they'd probably say it is correct.
Huh? Well, You got me then. What about using a letter that says, the judgement no longer exists, therefore you can't report nonexistent debts, so delete. Do you think that would work?
I guess it's worth a try. The only good thing about this is it isn't my report this time.LOL It's a friend of mine. For once it's someone that I'm trying to help.
LKH - Did you say that Judgements in Arizona are only good for 5 years unless renewed? If that is true, can I dispute a judgement from 96 as past the state's statue of limitations????? Thanks.
Judgments in Az. unless renewed are valid for 5 years. As far as disputing it, that's what I'm trying to find out. I'm trying to figure out if that is a valid reason to have it deleted. My thinking is if the judgment is no longer valid, it is nonexistant. If so, it should be deleted. If they refuse to delete it, I would think that would be a violation of the FCRA. But, then again, I could be all wet on this.
I live in AZ. I have had very good success having judgements removed from TU and EXP. No luck so far with Equifax but I have never tried disputing it as expired/past statue of limitations. I think that I will try that next with them. Experian and TU took a couple of tries but they took them off without any hassle. I just disputed them as not mine. I've also had a lot of success with disputing experian items through the website instead of directly with credit data southwest if that helps at all.
5 Years? NO WAY! That would be great! I'm here in Phoenix....I have a $500 judgement 9/97.... It's the next thing i'm about to dispute. But if it's true that in AZ it's only 5 years and my dispute doesn't work, hey I only have 8 months left I'm so glad you posted this tread.....How can we find out for sure if it's only on the Cr's 5 years? thanks Me
I think you are missing the point. Judgments are valid for 5 years unless they are renewed by the creditor/plaintiff. The FTC says derogs can be reported for 7 years. It says nothing about what to do if a judgment expires. I'm hoping it can be removed due to the fact that if they are reporting an expired judgment, that is not 100% accurate. And if they continue to report it as just a judgment, that also is not correct. I may have to ask an atty. about this.
