I have read the lenghty post of proper validation as well as looking partly at the FDCA. My question simply is this. Everything I read talks about if I respond within the initial 30 days to dispute. Do these rules apply if I respond years from when it was placed on my CR. Another words let us say that I review my credit and find an entry that was origianly put on 05/01. If I request validation are they required by law to give it to me? Am I still covered under the guize of the 30 day rule? Thanks, Scott
Validation must reads Per Humblemarc http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=343640#post343640
If I request validation are they required by law to give it to me? SPGardner ================== They are are never required to validate before or after 30 days,
Yes, I have attempted to read the court cases that he was prescribing but everything that I read talk about within the initial 30 days. There has to be some case law about someone finding out that there credit contained errors and requested validation after the origianl 30 days.
It's great the LB always explains what he is posting. A ca is never required to validate. But, if they do not validate per a consumers request to do so, they must immediately cease any collection activity including reporting to the cra's. So if after 30 days they don't respond you send an estoppel. If they don't respond to that, then you demand they remove it from your reports or be sued. And if they don't remove it, you sue them.
Question on Validation SPGardner | 6 posts since May 2003 66.174.62.121 | 05.29.2003 @ 16:28 +Thanks. That pretty much sucks. ===================== All it means is they don't have to validate if they cease collection activity. However you can still sue them for violations even after they cease collecting.
