Question Regarding a Voluntary Surrender

    As a result of a Stroke and resultant Disability I voluntarily surrendered my BMW stick shift auto (because of medical expenses and the paralysis which made it hard to use a stick shift) That was in June 2002. I was forced to file for a BK on Aug. 2002 and in Schedule F included the said vehicle or any shortfall as my claims and liabilities.

    After 6 years should this Tradeline show up only on TansUnion an a negative item or should I dispute it. I live in AZ. and I believe it may have passed the S.O.L. but I'm not sure of where to look for that information.

    Please remember the difference of what SOL means and negative entries on your credit reports. SOL is the time between first date of delinquence and the time the creditor can sue you. Negative credit information can stay on your reports for seven years. Being that your car loan was discharged in your bankruptcy just means that the lender can no longer come after you, but can leave the information about your bankruptcy on your credit reports. That entry however should fall off in 2009 - but the public notice/information will stay on there for another 2-3 years.

    You can try disputing it as obsolete. It may fall off early.
