i received a letter yesterday from tu stating that the reinvestigation is going to take an additional 15 days being that i supplied additional information, but in fact that is not true, i only sent a dispute which they received on 06/22/06, and now say that they have till 08/06/06 to complete, is that true. the additional data they claim i sent them was two days after they received my dispute. i did not send them anything i only sent my dispute which they received 06/22/06, nothing else. also they sent me another letter that they will not investigate 3 paid collection accounts because theywere verfifed about 8 months ago, can they do that. and whats a good way to remove lates. thanks
1. If you did not send in any "additional information" and they fail to complete the investigation and send you the required report within the original 35-day window, they have violated the FCRA, exposing them for liability under Sections 616 and 617 of the FCRA. Once they violate, you've got leverage to demand they delete the tradeline. 2. If they are refusing to investigate tradelines that were "verified" 8 months ago, were those tradelines properly verified? Did you request a description of reinvestigation procedures? What did they send you after those disputes? In this case, did they comply with the timing and content requirements of the "frivolous dispute" notice per section 611(a)(3) of the Act?
no all they said it was frivolus, also i asked in my letter to give me some sort of proof on how they investigated the information and they came back with the ca address and phone number, and then i asked them what proof did they provide to say that those were my accounts and they told that they do not have to give me that information, if they feel the results are accurate that is all that counts. but my concern is how can we find out , even if they have the correct names or anything in that matter, in my case i am jr and my dad is sr, when i contacted one of the ca they said all they have is my social, my name and my old address they dont have jr or sr. so isn't that an issue. thanks
If they claim it's frivolous, then here's what they are supposed to report to you: If they did not "reasonably" determine your dispute was frivolous, they have violated the FCRA. If they failed to provide the notice required above, they have violated the FCRA. Did they say why they determined your request was frivolous?
just because they previously verified, and it came back verified from the ca and any claim from me now is considered basicly bs.
Do you know this is not your account? Are you dealing with other similar accounts that are also not yours, perhaps due to confusion with your father's accounts?
they are mine , but they have been paid full, back in 03/05 for old phone bill and old x-ray i had but its all been paid. thanks
