I disputed items with the CRA's in November. One item came back deleted. Today, I noticed that it is back on my report. Aren't they supposed to notify me of this? I called the CRA this morning and they said that they do not have to notify me if the CA is just answering a dispute. This doesn't seem right to me. They just added this deletion right back on there. Please help.

They have 5 days from the date it was reinserted to notify you. If the CA fails to respond and it is deleted because the 30 days is up, they STILL have to abide by it. It's in the FCRA.
You can use this as leverage for possibly deleting other things on your report.

I'm on the phone with them now....she said

They have the right to re-report it! Now what do I do? This is so confusing.

Read the FCRA......if it has been re-inserted they only have 5 days to notify you. If they fail to notify you, that is a violation. I have all 3 CRA's on this right now (in my pending suits). They can't argue with hard printed copies of reports showing account was there, then gone, then 2 months later re-appeared.

First off STOP CALLING THEM!!! lol, some $8 an hour rep is not going to know what is in the FCRA, let alone KNOW what the FCRA IS!! If you keep calling they will do one of two things:
    1. Send you the updated copy with it on there
    2. Re-investigate the item.
Wait for 5 days until the first time YOU noticed it being back on there, then proceed.
You can either threaten a lawsuit, for not notifying you of reinsertion, or just find a higher up (look for #'s here) to have them delete it.
If you can wait a little longer maybe you should redispute and see if it comes back verified, when it does ask for procedures used, when they DONT send them to you, thats another violation, therefore giving you more leverage to get your report cleaned 100%.

Thank you. I'm not calling back. I'll start the process of what you suggested. Then I will go the courthouse and file. I've had it with these people. You can't get a straight answer from any one of their reps. They have no clue.

I found it. It's in section 611. Should I go to the courthouse or try writing a letter to their consumer complaint department?
