What is the proper way to include a account on your BK papers? Example: Capital One account went to a collection agency before I filed BK. Who would I put on my BK papers Cap One or the collection agency?
Depends who owns the account, if Cap 1 just hired someone to bug you about it and try to get the money... then Cap 1. If the account was sold off to someone, then whoever it was sold off too.
Actually, include them BOTH! It can't hurt anyone to do so and it protects YOU. I have had to file 2 BKs and I always filed both.
No, on your credit report or not makes no difference. Incl them both - cover your bases. Besides that, just because your CR shows it was "purchased by another lender" doesn't mean its accurate! LOL
Most BK Courts would want the creditor matrix to be something like this: ABC Furniture 123 Main St Your City, YS, 00001 XYZ Collection For ABC Furniture 456 S Nowhere St Their City, TS, 99999 And yes, you would list both in the schedules, just as above, but only put in an amount owed for the Original Creditor
I did not name it as you stated, therefore can the original creditor come after me for the money? The collection agency never reported it on my Credit report.
