It all depends on who files suit, discover or a third party debt collector.

Why not try to work out an arrangement with Discovery to prevent a lawsuit?

i tried.talked to some one about giving them 50.00 a month for a little while until i got on my feet.i was told that was to small amount.i said that was all i could afford for now and so i even paid at the sears store anyway. they wanted more so now i just stopped paying them.they wanted the payments caught up about (400)plus almost 100 per month.im probably judgment proof, have everything in the wifes name and im self employed. checking acct. is kept at less then 400 in my name.
