questions about bankruptcy

    if you file bankruptcy can you get back a car repoed already like if my friends files tomorrow can she get back the car they took today.

    or is it too late and the card had a co signer what would this do to the cosigner.

    please advise.

    Godes,

    I would recommend your friend consult a good lawyer. I think its possible to get one back, but obviously she is going to have to get it caught up, and the OC may not be so willing to give it up if she files as they may want to recoup the losses.

    WHAT ARE YOU SAYING ... IF SHE FILES DO YOU THINK THEY WOULD BACK DATE THE FILING DATE TO GET IT BACK. ALL SHE HAS TO DO IS BE PROTECTED PROIR TO THEM GETTING IT RIGHT AND DO A RE AFFIRM OF THE LOAN

    SHE DOES NOT CARE ABOUT PAYING ALL THAT IS OWED BUT SHE WANT TO GET THE CAR BACK IS ALL

    That's not the way the game is played. You can't keep secured property unless you can get current and stay current.

    WELL SHE WAS MOVING FROM ONE JOB TO ANOTHER AND GOT BEHIND... BUT NOW HAS TGHE ABILITY TO GET UP AND STAY UP. IN THE MEAN TIME WHAT TO DO... IS THE QUESTION TO GET IT BACK.. SHE WANTS HER CAR AND WILL DO WHAT EVER EVEN IF THE IS FILE.. BELIEVE ME SHE DOES NOT WANT TO BE WANTS HER CAR JSUT THAT MUCH.... IS THE SITUATION.

    PLEASE ADVISE

    How long since the repo? SHe needs to contact the auto finance company and make payment arrangements. This will hurt the credit of the cosigner and the collectors will start coming after the cosigner for the money.

    REPO WAS THIS MORNING


    SHE SAYS THEYWILL NOT GIVE HER CAR BACK

    She might still be able to get it back, just tell her to go see a bk lawyer asap.

    Bk is a drastic step to take, there's also a lot of other factors about her income, other debts and expenses that need to be addressed before she'd know if filing would work in her circumstances.

    See an attorney.
