Questions on Time to Respond

    I sent out a nutcase-ish letter to my student loan servicer (not paid in full yet) detailing the issues they have had in proper credit reporting. My ace in hand was the letter they sent to me along with a spreadsheet detailing over 26 erroneous derogatories on my credit. I still have not heard back from them and I gave them until tomorrow to respond with deletion or I sue them for their admitted infractions. (It has taken over a year, 5 contacts and 4 phone calls for them to admit fault).

    My question is: Does it usually take longer for a decision to be made on deletions? So is a long wait good news or should I start the paperwork to fax at 5:00 PM tomorrow?

    As I have 26 violations should I even look at small claims court or start in Federal?

    Have this same issue with waiting for response from 2 cra's I have sent ITS letters for. I guess if I dont hear from them, I will draw up a petition and fax it to them as a "copy of what is being filed in court on xxx day (probably 5 days out) I will put a notation on the letter that says "this is a last attempt at trying to resolve this in a sincere manner. Upon presenting my case to the court, it will be evident of my honest attempts to resolve this in a reasonable fashion. By not addressing these issues, it demonstrates, not only to me, but to the court that you are unwilling to rescind this erroneous information from my credit reports and thereby proves you are knowingly and willingly comitting offenses according to the fcra as well as demonstrating acts of libel per se and credit disparagement, which are all punishable by fines and monetary damages."

    Doll it up how you see fit...of course, others may disagree and say go for the jugular. I am all for that too, but, like I said, showing all efforts of good faith on my behalf should only get the courts to see I sued as a last measure.

    Let us know if it works (no, I'm not using you as the guinea pig, lol).

    Thanks!!!! I'll have everything ready for Thursday at 5:00PM and update on how it goes and what I fax. I was thinking about allowing just 72 hours for settlement but five days will work better with my travelk schedule.

    Not sure if it helped or not. Its like a poker game, ya know...you have to let them know youre serious as well as being able to bakc up what youre trying to do. Like I said, others may disagree with my approach.

    Just hope it works with my stuff and the CRA's. They can either be very helpful or a buncha tighta$$es when they want to be.
