I need proof of when a CRA verified a dispute I had. They send out a basic investigation report but there is some univeral something letter that the CA sends them and I need a copy of it. Does anyone know the full name(like udf or something) and do I have a right to get a copy of it. IF I do, and they balk, what law should I state to get their attention. thanks
It's called a Universal Data Form. You can certainly request a copy of this for your records, but I'm not sure if they legally have to provide you with a copy. Do you have some other written proof that the CA agreed to delete/update your account? In other words, when they agreed to delete/update did you get written confirmation from them?
The CA never agreed to delete. The problem is they never sent a 30 day initial dispute form so when I learned I could validate I sent the info in and disputed with the CRA. They actually verified during the validation so I need a letter stating the actual date of verification so that I have written proof of their transgressions in the event this goes to court.
Not sure if there is such a form. If the CA has not responded to your original request for validation, the next step is to send the estoppel letter. Seems like you have at least one violation(so far) because they did not mark the item as *In Dispute* once they received your validation request. I'd send the estoppel to make the paper trail larger! What CA are you dealing with?
united collection bureau out of toledo, oh Holy cow I cannot believe the stupidity of this woman on the phone. On june 12th we applied for a mortgage through executive bancorp. Here is the hard inquiry. THE CREDIT BUREAU INC Address: 520 E MAIN ST CARNEGIE PA 15106 Date of Request: 06/12/2002 Comments: Conventional mortgage on behalf of 113 EXECUTIVE BANCORP. This inquiry is scheduled to continue on record until 7-2004. -- The took all the info and I have and I never heard from them again and I never received a 30 day letter stating I was turned down and why. I called credit bureau inc and she has no clue and denies even knowing who executive bancorp is. She keeps tranferring me over to cbc credit services. I am going to file a complaint with the BBB now. Does anyone know the statute stating they have to send a letter within 30 days of being turned down and the fine. thanks

If any person takes any adverse action with respect to any consumer that is based in whole or in part on any information contained in a consumer report, the person shall (1) provide oral, written, or electronic notice of the adverse action to the consumer; (2) provide to the consumer orally, in writing, or electronically (A) the name, address, and telephone number of the consumer reporting agency (including a toll-free telephone number established by the agency if the agency compiles and maintains files on consumers on a nationwide basis) that furnished the report to the person; and (B) a statement that the consumer reporting agency did not make the decision to take the adverse action and is unable to provide the consumer the specific reasons why the adverse action was taken; and (3) provide to the consumer an oral, written, or electronic notice of the consumer's right (A) to obtain, under section 612 [§ 1681j], a free copy of a consumer report on the consumer from the consumer reporting agency referred to in paragraph (2), which notice shall include an indication of the 60-day period under that section for obtaining such a copy; and (B) to dispute, under section 611 [§ 1681i], with a consumer reporting agency the accuracy or completeness of any information in a consumer report furnished by the agency. The FCRA does not give a deadine of when they have to furnish you with a adverse action notice.
Thats for the statute. However, I see alot on forums that they have 30 days to respond and I was told that by experian. IT also says so on those turn down letters I seem to collect(sigh).
no no you did great and helped me out alot. I finished my BBB with the statute you provided and now I will await my response. they can easily send me a letter stating they have no record of this which she said was so or they can do nothing and your statute that I pased on their report will give me the ammo to file an intent to sue letter which only an idiot in this situation would not give into.
Get the contact info from the CRA regarding this company. Contact your state's department for their registered agent info. File suit and send it off to them. They can then figure out themselves how or why they did it and didn't comply with the law. They can also send you a check for your inconvienance! Tac
I have that same inquiry...don't know anything about this..I didn't authorize it. What's the first step in deleting this?
I fired off a complaint with the BBB to see what happens. They have a good BBB record and even have that symbol next to it so they have to respond.
