Hi all. Quick question. Should I send a dispute leter to the CB's and validation letters to the OC's at the same time or should I wait?
There is some debate as to whether or not you can request a Validation per se with a DV letter to an OC. You can dispute a debt with them, but the Validation letter is usaully meant for a CA. In that situation, you send the DV, i.e. Validation letter to the CA, via CRRR, (That green, certified return receipt thingy at the Post Office.) Once you receive the CRRR slip, then send written dispute to the CRA's. Once the CA receives your Validation letter, they are supposed to mark your account as "In Dispute" on your CR at the CRA's. They also can not verify" with the CRA's when they come a calling, unless they have Validated with you. If they don't mark account in dispute, and if they verify with the CRA without first Validating with you, that is 2 violations = $2,000 if/when you file suit. You are hoping the CA can't validate or won't validate, and when the CRA calls them to verify they can't, so CRA deletes the tradeline. Or, if the CA messes up by not marking your account in dispute and/or verifies to the CRA without Validating to you, that's a violation and you can threaten to sue the CA, but since you are a nice guy, if they will just go ahead and delete your account from the CRA's, then you won't sue.
