Racking violations up on NCO ?

    I send in a validatin request to NCO for a $205.00 medical bill, I sent it CRRR. I got my green Card back and when I did I disputed on Equifax and TU, which are the only one showing it. I have been checking my report daily and NCO has never notified the CRA's of validation request, at least it is not documented on the reports. also, EQ changed the status of the account to unpaid, after I put in my dispute, so I'm assuming that they have contacted NCO and NCO verified the account while I have not rec'd back validation from them yet. Are these violations legitament?? or I'm I grasping at straws here? I'm watching them very closely.

    I would send intent to sue letter, and print out those credit reports right now.

    Should I wait out the 30 days for them to respond to the validation request, which will be July 4th. or are you saying I should sent out the intent to sue right now ?

    They never marked in dispute? or are you disputing it right now with the CRA?

    I would send it. But I don't think it would be intent to sue, I would send the actually summons.

    No, when I sent the validation into NCO, I gave them 5 days by law to report to the CRA's that the account was in dispute for validation, it was never documented as far as I could see. I rec'd the green card and they rec'd the request on June 4th, I then disputed the tradeline with the CRA's on 6/10. When I pulled my reports tonight there was a alert that there was a change. It was NCO status that was change to Unpaid, and the comment is still on there that Consumer is disputing ?

    I think that anyone catching NCO in violation, needs to SUE! Their guy talked to hubby about my alleged debt, said that I didn't respond in 30 days because I probably can't read or write, and that he had a copy of my credit report and it is sooooo bad I probably have no intent to do anything about it!

    Let's see, this debt was discharged in ch13 2.5 years ago.

    Not to mention that I have an EE degree with a minor in physics. And. of course. some untrained HS grad (maybe) is calling me stupid!

    You bet I checked INQs and there weren't any from NCO!

    KATHY The validation letter gives them 30 days to validate. Their time is not up yet.
    If you send them anything now it will make you look bad in front of the judge.
    My advice:At the end of the 30 days send them the 15 day Estoppel letter.

    Well, I got no response back from NCO by July 4th. but I had to have surgery on July 9, so I did'nt get the esstoppel letter out right away, which I was hoping to do. I just could'nt concentrate on anything with the sugery and all the testing I had to have. anyway. When I got back on my feet (2 weeks) I sent out the estoppel letter on July on 26. I have not gotten back the green card as of yet, so I'm just waiting. gave them the 15 days to respond after receiving, I also sent it CRRR. I also pointed out there violation within the letter. so I guess I'll see what happens with this, and If I still get no response I'm sending the intent sue. I plan on going all the way with this. I'm not letting them off the hook!!

    sorry, I was'nt on the board over the weekend. sorry that this took so long to respond to you.

    this is the collection ageny that I 'm working on my intent to sue letter for. No, I have gotten no response to any of my letters. So now I'm working on my Intent to sue. I disputed something on equifax and the results are due back 9/13, so I'm going to wait to see what that says, then after that I'm sending my intent to sue letter to them. I know that they will verify. I just wanted to give them one more chance to redeem themselves.

    Update: 9/18/02

    Well, I got the results back from Equifax on this lovely account. They deleted it. Now I hope it stays off. If they do put it back on my report. there in trouble, because I have them on so many violations on this. I was getting ready to send my intent to sue letter after the results, but I guess I don't have to send now ? I was just looking for them to delete the account and they did.
