I have a pd chgoff on Experian that got re-aged recently. I sent EX a copy of one of their credit reports showing the old, true dates of the derog asking them to fix or delete. They verified it. Arrgh! I'm fairly certain the creditor is the one who re-aged it. The woman I've dealt with at the creditor, after trying to get a validation, was pretty hostile. I'd prefer not going back after the creditor. Even though it was probably the creditor who did it, can I still hold EX accountable? I have about 20 CR's that show this derog with the same dates, right up to the re-aging. It's my last major derog on EX and I want it gone. I'm thinking I've got a valid law suit, but I'm not sure.
You'd think these dimwit CRA's would get their acts together. Well I'm done playing around with EX. I filed an FTC and BBB complaint. I'm working on the AG complaint right now, the TX AG let's you send scanned documents in support of your complaint. I just need a contact at EX to send my intent to sue letter to. I don't care if they fold and remove or let me actually file, they're gonna loose.
Most times the cra reports only what the creditor reports. Now, the cra probably is just as guilty as the creditor, but if you sue, maybe should also included MBNA as a defendant. They probably reported it that way.
In this case, I think it is the creditor. When I sent in a modified validation to get a response out of them, they sent me a letter to contact Ms. X . She continually tried to contact me via phone and was anything except pleasant. I sent another letter asking her to respond to the first letter and keep the contact to mail only. Then she sent me a "Fraud form" to fill out. I ignored this and a week or so later I got a letter that said her investigation concluded and I did owe the $500. So I'm thinking, wtf, the chgoff was paid off 5 years ago. I decided to stop messing with her and just spam the CRA, because there are a couple of inaccurcies in the tradeline. After the last verification, every date except open, showed up as 10/2001, re-aged. I'm not sure where you came up with MBNA, it's Airtouch Cellular now reporting as Verizon. So what I really need is a good contact name at EX to send the intent letter to. Anyone?
Pat, I didnt have any names I just sent my intent to sue letters out this past week and sent them to the address I had. However, I did have the post office cancel the actual letter and keep copies of it so they can't dispute what I sent. I gave them 15 days and told them I would be filing. I also included a copy of the small claims forms already filled out Minus the case number so they will hopefully know I mean business. I'll let you know if I have any success with them.
Christi, Good idea on having the letter canceled and sending the small claims form. I think I'll borrow those ideas Please keep us updated on what I hope will be your success! I just finished scanning and documenting everything for the TX AG and sent it in. We'll see if that does any good.
