I have questions about re-aging accounts. My Mom has a negative item from American Express that says it was charged off (on her EX report) 4/1997. Now she actually thinks that she stopped paying in 1994, and she has not paid anything since. American Express, every month keeps re-aging this account so it looks like this is a â??newâ? item hurting her score even more. That is illegal is it not? What part of this law says this, if someone could point it out to me? I was wondering if I should dispute with the CRAs that it has in fact been more than 7 years (since she was delinquent 30 days plus 180 days) that this is on her report. Do they have to prove this? Charge off dates donâ??t count to they? And if they canâ??t prove when she was first delinquent 30 days, then donâ??t they have to remove it? I live in GA and the statue of limitations for is 4 years so she also doesnâ??t have to pay this that is why I think they keep re-aging it every month. Thanks, El
They could just be reporting it each month. That is not illegal. On Experian, look on the side, it will usually say something like "This account is scheduled to remain on record until xx/xxxx" That's the only way I can tell what the DOLA is on Experian.
A simple phone call today is all it takes and that item is gone forever. I am surprised they (CRA's) haven't taken it off by now.

By the way El; Re-aging is illegal. Consequently it's unlikely that they would have this set up to re-age every month, month after month, although possible I guess. Usually when they re-age they add a couple of years and bomm, hit you all at once. Better to violate just once than 12 times a year. See?
