What do I look at on my c.r. to see if they reaged my accounts. I have three separate car loan accounts (they are all for the same car)-yes they reported it three times on my c.r. What date do I go look at for the drop off date? one says repossession as off 5-2000,the other says charged off 7-2000, the last one says charged off 9-2001 (and keep in mind I filed for bankruptcy in 5-2000, it was discharged in 8 2000)
I have yet to see it except in tri-merge reports pulled by some brokers and realtors. For the most part its just not ever shown. So you have to figure it out for yourself using the info you do get and going from there. You probably need to count back about 120 days after chargeoff.
Bill, from reading my post--does it look like Onyx Acceptance corp is reaging my account (it is the for the same car) 3 separate entries on my credit report Thanks again for all your help
Are they reageing? That is a tough call because most reageing attempts are a lot more obvious than that. This one looks more like just inadvertant error than an attempt to do something illegal. Be that as it may, I tend to look at it as a golden opportunity. You see, since its been resolved in bankruptcy you are not liable for the debt and the whole point is that you hate to have all those reports on your credit because it makes your score worse than it should be (maybe) and it just don't look good on there at all. Since its been essentially outlawed in bankruptcy it seems that they are essentially claiming it isn't and may be attempting an illegal collection after bankruptcy. So, since I tend to think it often pays to be dumb, to be dense, to be ignorant, I would dispute the chargeoffs if any balance is shown due and payable by demanding validation from the CA or whoever is reporting it. If it isn't properly validated within 30 days I would jump all over them telling them they are in violation of FDCPA and give them the quote from FDCPA that says they have to validate and yada, yada, yada. And if you don't get me a full and complete validation to show me that I owe you and why I am going to sue you. Yada, yada, yada. And hope they fall for it. If they do send you the validation then dispute it with the credit bureaus and see if they will verify it too. Then if they get that stupid go scream to the bankruptcy court and let them do your dirty work for you. If nothing else, you ought to get a good laugh out of it and you just might get them in a whole kettle of hot water and get rid of it that way. Hey, what have you got to lose? After all, don't you have the right to be one of them there critters known as "the least sophisticated consumer?"
all three have different account numbers (they just added a few numbers at the beginning of the account # and the only one showing no balance is the repossession. The other two are still being updated everymonth. Thanks alot again
Then go after the two that are still in active pursuit. Let your good old Uncle do your basic dirty work for you. If he will go lay a knot on their thick corporate skulls then you still have the right of private action backed up by Sammy if you want to pursue it. Play your cards right and you just might be able to ride around in your new gold plated Cadillac paid for by stupidity. (theirs)
I filed bank in WA State, can I go to the bank court here in VA (gotta find it first) or can I just call bank court in WA state. Bill--I must be really slow, because I'm confused on the first step I need to take--I have been reading this board for weeks now (you can say I am addicted) and still don't know what to do!! I just don't want to screw up
I know almost nothing at all about bankruptcy so maybe you could go to the court in VA but I tend to think you would probably have to write a letter to the court in Wa. where you filed. The first step is make them validate if you can. The second step is make the credit bueaus verify and then go to the bankruptcy court. The third step is to end up with the result of the crooked painter who used paint thinner to water down his paint to make the most profit. He got a contract with a church because by thinning so drastically and so he went to work. He almost got done when a sudden rain storm came up and washed all his paint off and just as the storm passed over a bolt of lightning hit the side of the scaffolding knocking him to the ground and a booming voice came out of the thunder and said. GO YE AND THIN NO MORE!
