I am a new poster here but have been reading for about 2 months now. The information here is so abundant and helpful. Thanks CNetters! Here is my situation. I have a CO/collection listed under CA ASSet Acceptance. I called Discover who is the OC and found out it was charged off 11/1997 and sold to Gulf 12/1997. The last payment I made on this account was 3/1997. Eq has this TL showing DOLA as 5/97. Since the CO occured prior to 12/97 when the 1996 FCRA Amends took effect, would the 7 year period begin 11/97, 12/97 or back to 3/97? ASSet actually got a defaut judgement on this in 2001 which shows on my CR under Public Record and is paid. I am anxious to get the TL removed though. BTW, when I started reading here, my EQ FAKO was 598, now its 621!!! Thanks to all of you!!!
You probably don't want to hear this. March of 2004 dispute with the CRA that the original account and therefor any collection accounts associated with it are 7 years old, this should cause them to fall off. The default judgement won't fall off until 2008, thou. Actually it may be later than that, depending on how long after they got the judgement you paid it off. 7 years from the date the judgement was paid. It sucks, I know, and the judgement should be linked in some way to the original debt, but the judgement is just a piece of paper from the courthouse, and the courthouse will continue to state that the judgement was filed in 2001, was paid in 200X and so the CRA will report it for 7 years after the judgement was paid. I don't know how much luck you will have, but you can attempt to have the judgement vacated (which makes it void) and since you've paid it, you won't likely get any opposition. If you can make a valid case to the judge that the judgement wasn't properly served or is invalid in some other way you might be able. Hope I didn't shatter your hopes too much. ChrisB

I stated "Eq has this TL showing DOLA as 5/97" Actually, it is not showing on EQ anymore, it is currently under dispute by CMRR ;? Originally, I disputed it as being past 7 yr SOL with 3 other TLs and it came back verified along with an old WFFNB/Lane Bryant TL. They stated that the balances were being reported as $0 and that $0 balance accts were reported for 10 yrs. I disputed it again pointing out that regardless of payment, 7 yrs is all they get and THEN, I got the infamous stall letter (Request for utility bill etc. to confirm my identity). I unwittingly sent the info they requested, but did not hear from them again. I then resent my dispute with copies of all previous correspondence CMRR and poof!! neither TL is showing on privacy guard. But EX still shows the account I NEED it off of there bad! It's killing my score. FAKO EX=608. FAKO TU 651!
Re: Re: Re-Aging this debt? This is incorrect. Judgments stay on your report 7 years from the date the judgment is rendered/entered, not the date that you pay/satisfy the judgment.
Re: Re: Re: Re-Aging this debt? Cnoob, Sorry for the mistake. I wasn't thinking. The way I see it, paid Judgements should act the same way as paid charge offs, and so dissappear 7 years after they appear. I agree with you, the judgement will be there for 7 years from filing, so 2008. ChrisB

Actually: (2) Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period. But hey, what CRA follows the FCRA anyway? They certainly wouldn't know a state's SOL. LOL
Re: Re: Re-Aging this debt? You may be confusing regular judgments and tax liens... Paid tax liens remain on your report for 7 years from the date paid, not rendered/filed
