Two weeks ago, I got the results of a TU dispute where they deleted an account (that, by the way, does not even belong to me - honest). Anyway, last week I got my report online, it was gone. Today, I pull a new report, and there it is again, updated in 6/2002. I have the letter showing that TU deleted. Have copies of reports with it missing - and re-appearing. How many violations do I have them on? (I have a copy of the FCRA but I am not too hip on figuring this stuff out.) I want to get them for as many as I can. I would be happy with a clean report - maybe a little cash - but more than anything, a clean report. Have any of you filed suit for this and if so, could you direct me to some good links or tell me what the outcome was? I have done searches on re-insertion, but most of what I am getting is pretty vague.
Ok - I know this isn't a very intriguing post - but have any of you dealt with TU on reinsertions? Should I send an intent to sue letter or should I just go ahead and file? (By the way, I have supplied proof that this is not a valid account to TU. However, they reinserted anyway.)

If they do not notify you within 5 days of reinserting that account, then you would have them on 1 violation of the FCRA. With the upcoming holiday, and since you checked today and saw it on your report, I would wait until at least Thursday of next week be "calling" them on the violation, that is, if you decide to play hardball with them.
Mindcrime - What are the chances that I could get some deletions out of this? I could sue for $1000 - right? I would much rather have deletions.
whyspers is going after EX on the very same issue. I would suggest you at least wait out the 5 days, and just to cover your bases, don't count tomorrow, Saturday, and Sunday. So, wait until Thursday, maybe even Friday of next week (6/11,6/12). Now if you're referring to having this one account deleted, then you might just want to call TU next week, explain to them that the re-inserted, they failed to provide you with notice within 5 days, and that they need to delete this item, otherwise, you have no problem in filing a lawsuit, and you have all the proof you need that they violated the FCRA. Now, if you do not feel comfortable in doing so on the phone, then put it in a letter, and send it CRRR. As far as getting a "clean" report, you will most likely have to go as far as actually filing the lawsuit, and once they are served, their attorney will most likely want to settle with you out side of court. At that point you can ask for deletions in lieu going through with the case. A CSR on the phone, or even a supervisor just wouldn't have the authority to clean your report just for the asking. Yes you could sue for up to $1000 per violation, however it could, depending on the judge only net you $100 per violation, per the FCRA.
Actually, I have a few things in dispute right now and the results are due on the 11th, so I will just wait until TU mails my updated report and see if it is still on there. TU is my worst report - very low 500's (I can't remember the actual score right now, but it stinks.) I will try to find some of Whyspers posts regarding this. Thanks for the info, Mindcrime.
