Re-insertion letter

    Just found something re-inserted into my Experian report and fired off a let ter to them I thought i'd share in case anyone has a similar situation or just wants to make a comment.

    Everyone here has been very helpful, i'm just trying to give a little back.

    I just became aware that an item has been reinserted into my credit file which had previously been deleted. According to the FCRA, a credit reporting agency may not re-insert a previously deleted item unless its accuracy and completeness has been verified. Furthermore, a credit reporting agency must provide a written notice informing the customer of the re-insertion.

    I have as yet not received a notice from anyone at Equifax nor do I believe Equifax received a complete and accurate verification of the item in order to re-insert, therefore Equifax is technically in violation of 2 items with regards to the FCRA.

    At any rate, I am including a copy of the letters I received from Alegis Group, parent company of Sherman Acquisitions, in order to facilitate your investigation. I trust that 5 business days from receipt of this communication will suffice in order to clear up this discrepancy.

    Please be aware that any further violations of the FCRA will result in legal action in the appropriate jurisdiction.

    What letters are you sending them? What do they say?

    I had Equifax and transunion re-insert something on my CR's. I called them up on the phone and got immediate deletion. EQ even coded it so it will NEVER re-appear. Both of them took some fighting and direct quotation from the FRCA. Don't give up if you call them, they will tell you your wrong.

    Please share the FCRA quotes you told them. It will help many people on this site.

    Its subSection 611(5). Read it, know it. Know what it says because they are going to give you all kind of excuses. It's all in there. I never threatened a lawsuit or anything like that. If the first person won't do what you want, ask to talk to a supervisor. Just keep going until you get what you want.

    Thanks for the advice. I just got off the phone w/ Equifax. At first the rep said the re-investigation would take 21-30 days.

    After i said i didn't want to wait that long and mentioned the FCRA, he put me on hold and within minutes came back and appologized and said they would delete within 3-5 days.

    You should have said you wanted deletion by the end of the day.
