I have been lurking on this board for some time, and finally have all of my ducks in a row to start pursuing my credit cleanup, including having read all of the required "n00b" reading To sum up my situation: I declared Bankruptcy (ch 7) 2 years ago in March. After pulling my credit reports, I find that only 1 (yes one) of my debts included in the bankruptcy are listed as "included in Bankruptcy." The rest are ALL listed as charge offs, past due, etc. with no account activity since 03/02. This of course is seriously affecting my debt to income ratio, as well as totally defeating the steps I took to make sure that every single thing was paid on time after the bankruptcy (car loan, unsecured credit card.) My question(s) is(are): Should I request that these items be changed to "included in bankruptcy" or dispute them completely? There are 2 that are for large amounts, (20k and 18k) and the rest are under 5k. Also included in the bankruptcy was a student loan, that is being reported at $9,900, by both the original loan company, AND a collection agency. Since it was over 6 years between the loan origination and the filing, it was supposed to be discharged as well. I've gone from furious to feeling helpless, as the bankruptcy did nothing but add a negative to an already battered report. Ironically, a visa card with a 200 limit is the only thing that shows "included in bankruptcy" hahaha. Instead of feeling bad, I am definitely ready to act, but don't know the best route to start with. Given that only 1 debt actually refers to a bankruptcy, I'd be inclined to start with disputing the bankruptcy and following up with charge offs. To avoid a "we're not doing anything you frivolous nutjob," I also think it would be wise to leave the bankruptcy alone and start with the charge-offs. Any advice is appreciated! Anybody out there with any insight? I promise I won't kick someone in the chops like "angry" did in a different thread
Hi, I am by no means and expert. After reading this is what I have gathered. I filed bankruptcy 2yrs ago also. Before finding this site, I disputed that they should be IIB. From what I have read, If you want to get rid of your BK. First get rid of the items listed IIB. So I would dispute as not mine. You also need to make sure you dont have any previous addresses listed with the items you are disputing. So first thing is check your personal info, Opt out, and then start the disputes. Here is my plan of attack. Personal Info Derogs - IIB CA's BK-Public record Hope this helps. Most of the questions I have asked were answered in previous posts. Also check out Artofcredit site. Good luck!
