Can you take a company to smaill claims court if they fail to remove an unauthorized hard inquiry? Some jack@$$ within the utility company pulled my report in error, now they don't want to do anything about removing
FCRA statute 604. Take em to court for $1000. I bet that will get their attention. If you are both in 1 party consent states then tape them refusing.
how do you know it's in error. perhaps somebody with access is pulling peoples' information for id fraud purposes ( or selling it for that purpose). file a police fraud and say you're concerned about id fraud... send them a demand letter for 1k... then file a lawsuit. not only get paid, find out who is in your report and for what reason. perhaps this person has done this to 100s of others and their supervisor just doesn't know it. I'm not being paranoid either... this is exactly how id fraud most frequently starts. raise Cain and then sue. You'll get the inq off and 1k (500 min) for your trouble). by the way, the person who pulled it can get a hefty fine and federal jail time... read the fcra.
Thanks guys! I have really been frightened when it comes to taking the offender to court, but in this situation, they have pissed me off to the highest of pisstivity! I called the "executive office" to complain, and the "nice person" on the phone told me that they periodically pull credit reports and that was more than likely why. My reply was, you pull soft inquiries not hard. Sorry, we aren't going to remove it. That was my last call of several throughout the month. His answer REALLY ticked me off, because it was obvious he didn't even take the time to read through my account notes, he just came up with the standard cover our @$$ answer. To add insult to injury when I requested a supervisor he told me he was the end of the road and there was NO one in the company that I could speak with. Legal - I won't give you the number. CEO - LOL, he doesn't take calls. So I politely (yeah right) asked for his name to add to my complaint. Anyway, One of the supervisor's called me back a little while ago and told me she pulled the alleged tape of the alleged conversation, and surprise, there was no conversation!!!! (What I have been saying from the start) So now that I have fulfilled the burden of proof on my end, she was forwarding a request to the credit dept to remove. I told her she needs to fax me confirmation of our conversation and outliine her resolution for my records. She said she would call me back. (No callback yet!) Sorry so long
