Back before my BK7, I had three accounts with my credit union, a Visa, a Line of Credit, and my home mortgage. The LOC and Visa were included on the BK, but the mortgage was not. It does show several 30, 60 and 90 day late payments though... I have tried several times to dispute the LOC and Visa off of my report, but they are right on top of things and validate them properly all the time. So I called them about a reaffirmation of the debt. I am waiting for them to call me back, but what terms should I ask for. I obviously want them to report that I am paying the debt, but should I ask them to remove the late payment notes from the mortgage. The mortgage is now completely paid off, and would show as a good tradeline if they were gone. Any ideas?
Hmmm. Are you talking about just making some type of settlement offer? If these debts were discharged in your bk, then you don't owe them, but you can pay back anybody whom you choose to regardless of the debt being discharged. It's up to them whether to accept your offer though. "Reaffirmation's" are done BEFORE your case is actually discharged and have to be filed with your court in the proper time frame to be valid. Sounds like you just want to talk to someone in charge and see IF they'll agree to some/any terms to remove the negatives from your report in exchange for a payment of some sort. Newstdt
