    I can't comment on Kim's situation but in my area I have sewer service provided by my township and the water is from a different company not located in my township. Two separate bills paid to two different places.

    I don't know how the township can operate a sewer system without water.
    It takes two things to make a sewer system work.
    1*A water system
    2*A sewage plant consisting of the net work of sewer lines.

    If you have both you can offer water and sewer service.
    If you have just a water system all you can offer is water service.
    If all you've got is a sewer system you can't offer anything.

    How does the township know how much to bill you for sewage? Is there a meter on your sewer line?
    I'd be interested in knowing how your arrangement works?

    If there was no lien at the time of the closing, the title company is off the hook.
    If there was a lien and they missed it, they are required to pay it.

    I used to work in the city water department in TX. We billed water & sewer. It was actually based on water usage - there was no such thing as sewer meters. We did have a max bill based on 10K gals of water. The theory being that anything over that probably was water that never entered the sewage system - ie pool water, sprinkling, etc.

    The same was true in FL, except the billed based on every gal of water used - despite the fact that most people watered their lawns year round!

    Maybe the separate sewer is actually subcontracted out to someone, and this city has a set fee?

    We pay a flat quarterly fee for sewer service and our water is metered. However, once I was late on my sewer payment and the township sent me a notice saying they were notifying the water company to have my water service shut off if the sewer bill wasn't paid by a certain date. So I'm sure there is some arrangement there, even though they are different companies.

    But what thecatslai needs to do is demand that Hazel Dell provide her with a copy of the work order.Don't tell them why you want it.
    There are thing on it that could tell her what she needs to know as to what's going on.

    Thought I'd update you guys. I've been dealing with the elected president of the HDSD Commission and the finance manager. They want to set a precedent with us because they think the statutes are really unfair for cases like mine. They are going over the law with thei legal counsel looking for any loophole that would let us off the hook. The law not only says they can request payment for as long as they have provided service but that they are required to collect.

    They have a couple of things in mind like attempting to collect from the previous owners that are gone and then writing it off as bad debt. He said not to give up and to be patient. He said not to pay anything but my current bill for now.

    The reason they made the law this way is because their is no way to shut off sewer like water or power so if customers don't pay the bill keeps adding up so they can put a lien on the house. They obviously did not take into account situations like mine where I was not the owner when the debt happened and there is no way to contact the previous owners.

    So I will wait and see what happens.

    When DID they "hook up" the service? Are you POSITIVE it IS hooked up to your house?.

    It might be worth your while to have a plumber look at your system and see what's what.

    Usually, when new sewer lines are put in, the homeowner has an option to hook up, SOMEONE had to pay for the hookup at the time, since apparently the house was constructed with a septic system.

    Actually it was originally constructed with a sewer system but the county billed for it. The county turned billing over to HDSD in 1995. That is when it was supposedly lost in the system. According to out title search the city was to provide sewer and water but I guess that was a typo and they only do water. It was a typo that caused me to think I was paying my bill when I wasn't though.

    Did you get title insurance along with your title search? If so, that may be considered a "discoverable" flaw that you would be covered for if you have any undue expenses. You should at least let your title insurance company know of the possibility of a claim, or you may lose the opportunity to have them pay, (if you DO get stuck)

    1*Nothing wrong with this: The person receiving service should pay for it.
    3*You don't have a current bill because you haven't received service until they have shown you a work order showing you are connected.
    4*This explains why there is no lien on the house.
    No service no bills = No lien.
    5*The owner has nothing to do with it the only thing that matters is the user of the service.

    Not yet. The finance manager said it would take a long time. He told me to pay nothing but my current bill for now. The law that governs sewer companies is pretty long and detailed. I tried to wade through it online and there was so much I didn't understand. I am going to give him copies of my title report so he can see the history of ownership and how it could be so confusing since they were not listed as the providers of sewer service.

    1*How do you know you even have or owe a current bill?
    What proof have you seen that service has ever been provided to you or that your home is even connected to their service?
    Where is a work order from them showing [1] the connection to your house & [2]Service ever established in your name?
    Just because sewer lines were found on the property don't mean you are using or they are providing you service.
    There should be two types or kinds of sewer lines on your property. One is the sewer COs. running across your property. The other is a private service line running from your house. Which one of these sewer lines was found when repairing the water leak?
    If these 2 lines aren't connected you don't owe anybody anything!
    2*That may well be but the laws you are under are the consumer protection and contract laws.
    3*How do I view it on line? Perhaps if could look it over I might get some ideas.

    5*If they Weren't / Aren't listed the most logical explanation would be it's because they weren't / aren't providing any service!

    Other than an out house there are only 3 ways to handle sewage.
    1*A public sewer service such as with a water company
    2*Private systems I.E. septic tanks
    3*A Central sewage system.

    Which one of these 3 is involved with your property?????
    Where is the sewage from your subdivision being treated?
    Have you seen the sewer treatment plant or equipment?
