I had a retail account that went to collections. The application was through Beneficial National bank USA and after being sent to collections was handled by Household Finance Corporation (Household Recovery Services [HRS]). After checking on corporate registrations through sec. of state and Household's website, it seems that Household Recovery owns Beneficial and it's one of their "brands", but the companies have been registered as stand alone corporations (not d/b/a), with different executives, etc. I'm interested in going to the next step after a 3 month ordeal with HRS and filing on them; yet I would like to make sure that the firm that I'm filing on is the correct one and that the laws are applicable to HRS as a collection agency. Can anyone offer any assistance or clarification in this manner?
Dear RThomas, Welcome to the board. Your efforts should always be targeted at the "Furnisher Of Information" as outlined on your CR. No matter who owns what you want to go after whomever placed information on your CR. Yes, in this case HRS is a 3rd party collector and governed by both FCRA and FDCPA. Good luck and keep us posted.
