I have a listing on a cr which is inaccurate. It is a public record. I disputed it as inaccurate, they responded by telling me that they will not investigate because I did not say why it is inaccurate. Is this correct? Do I have to tell them in what way the listing is inaccurate? Won't they just correct it if I do? Thanks!
Hi Terri, Pick one thing that's innacurate and dispute based on that. You don't want to "unload" your entire arsenal all at once in case you need to dispute again on different grounds. Good Luck,
Actually, I think it will. That is why I am reluctant to tell them. It is a judgment and the amount is incorrect. They left off a "0". It is much more than they list! So, I guess I will just work on a letter to offer to settle it for deletion. Thanks for the reply, Queen!
'not mine' should get your investigation started. (if the amount is not correct, then how can you be sure they are reporting your account...lol.) I always dispute as not mine if it is a derrogatory, because if the information is incorrect, then they must not be reporting my information. maybe they got someone elses balance mixed up with mine, etc. - you get it? Plus, you want a deletion, not an update. Do not go into specific detail, just state - account is not mine. I have never been asked to provide more information when I dispute using this method. If it comes back verified, then start using the other approaches, ie balance incorrect, never late etc...
Mitchra, I started with "not mine" in my original disputes last year. They verified. Then I tried "inaccurate." They said they will not do anything because I did not tell them how it is inaccurate. Thanks for responding
Firstly, is the address that you were residing at when the judgment was obtained on your report? If so, have that address deleted and dispute as NOT MINE again. If not... Have you asked for a procedure description? Be specific. Press them for the information they used to verify that the alleged judgment is yours.
You can always try "not mine" again, I would wait awhile between disputes though. I would not dispute the balance if the balance they are reporting is lower than it should be. Also, you can ask for the procedures used to conduct the investigation. If you don't get the procedures letter within 10 days, demand it be deleted, because you do not think they actually performed an investigation, violated FCRA etc... Keep in mind, getting them to do any research at all is risky, as they may figure out that they have the wrong balance and "update" if they see fit. They do not need your permission to update, as it is their duty to report "accurate information".
I still live at the address. I have asked for procedures on everything I have disputed, and I have never actually received any info. Sometimes a general description of what the cra does to verify, sometimes nothing.
I don't have that much time. I was hoping to just get it off the report for now, and pay it later. I guess I will just work on a pay for deletion letter. OOOOhh, Is that possible with a judgement?
Nope. The only ways to get a judgment off a report is by -disputing with the CRA, or -having the judgment vacated.
Darn. I thought I had read somewhere that there was a way to make an agreement when it was paid, maybe agree to vacate???
