Reasons for BK7 denial/dismissal?

    I may have to file BK 7 next month. Can anyone tell me why the court might refuse to discharge my debt under BK7? I just read a post by someone who applied for BK 13 twice, and was dismissed by the courts before their debt was discharged, and now it's opn their reports as a BK but they still have all their debts. My husbands income is high, but he's stuck with a lot of premarital debt and can't pay mine too. I don't have much income, and just lost my premarital house to foreclosure, and am facing the possibility of a suit by the HELOC lender because the house won't sell for enough to cover first and second mortgages. My credit cards are all maxed out but I'm paying them on time.

    A BK13 would be dismissed becaus ethe debtor didn't make the payments or applied for new credit without the Trustee's consent.

    A BK7 would only be dismissed because of fraud.

    If you are doing Ch 7, be completely honest on your petition. Tell your atty EVERYTHING and you should be fine. It is pretty rare for cases to get dismissed.
