I received a "bill" from a CA for apartment damage. There's a sentence that says: We are most likely now a part of your permanent credit file. Huh? Permanent? I thought this could only stay on file at most 7 yrs. Also my TU report does not have this listed as "disputed". I did send a validation/dispute letter to the CA. They sent nothing to me but more "bills". I then complained to my state's AG and the CA sent a letter saying they have it listed and reported to the CRA as disputed. They also sent "validation" thru the AG office as well. Mainly info that I actually lived there. They made no reply to the "permanent credit file". One other question. My girlfriend is also listed on this collection acct. Could we sue them together and get double damages or go it alone?
Negative information can remain on your "permanent" credit file for up to 7 years. Certain BK's for up to 10 years. Positive information remains on your "permanent" credit file for up to 10 years. TU's system does not report the "in dispute" notation (search for and see Marie's thread concerning TU/In Dispute notation). Each of you separately can sue for each and every violation of the FCRA and FDCPA. If they damaged her report and they violated the law, then she can sue too. -Peace, Dave
