I requested validation from Calvary Investments in Jan. Sent CRRR-NO Response. In the meantime, it was deleted by dispute. Re-Inserted without proper notification from CRA's. This re-insertion was within the validation period. I sent Estoppel Letter in March, CRRR No Response. Last week, I faxed an intent to sue letter outlining what had happened and that I expected these items to be deleted. Today, April 13, I received a letter from their attorney saying that he has instructed Calvary to update as in dispute and to provide verification of the debt. Now, I planned to sue this Friday April 19 in small claims court here in NC. Should I proceed as planned or respond back and give then one more opportunity to delete? I really don't want to go to court, but I will if necessary. Any ideas?
NCGolfer, I'd be really interested in speaking with you as I am in NC and am going to to small claims court. I'd just like to know what papers you filed and what kind of time frame they are giving you for your day in court. Any information would be most helpful. Thanks!
File suit for the violations they committed. Who cares if they finally got their heads out of their collective "fourth point of contact"? They violated the FRCA three or four times. Sue on those grounds and settle for $2K and deletion. Dancer
