Ok I got my settlement check from the CA I sued today. I was really nice and accepted deletion, they pay the bill since they were so sure it was mine, and they pay my $43 filling fee. Should I cash the $43 or because it has the name of the CA on it should I frame the check so I can gloat over the win?
Congratulations! Hmmm, I might frame it since it's only $43 - but at the very least photocopy it!!!! Mommy2cats
Yeah true I could do that. I called experian again and got the usual response. I am sending my final 48 hour intent to sue. They will ignore it like the morons they are and wednesday at noon I file. I ordered pacer so I now know how experian works in district court. They settled in every single case except the one that the plaintiff failed to show up at. duh
In order to look at cases in the us district court of northern or southern ohio you have to subscribe to pacer which is free to get but costs to look at each case. Basically it costs me around 40 cents per case. i just faxed out my 62 violation intent to sue which they will ignore as usual. Experian always tries for dismissal first as frivolous which never works for them. Then when they are losing they try and use a clerical error instead of willful noncompliance which will not work as I have like 6 faxes they just ignore or say they will do nothing about. Finally, they always settle out of court for nondisclosure which I will not do(unless the money is big wink). I still find it amazing they would rather ignore federal law and spend potentially thousands of dollars and dozens of hours of work when they could spend less than 5 minutes just correctly their mistakes.
Picantel, Did you attach a copy of the lawsuit when you sent the Intent to Sue letter to Exp? humblemarc
sorry was gone all day at our new house. I only sent the intent to sue letter. On wednesday I file so have made no copies of it yet.
